The learned counsel appearing for the State submits that the controversy involved in the present petition is covered by the decision of the Hon'ble Supreme Court in the case of India Meters Limited v. State of Tamil Nadu1 .

As none appeared for the petitioner, the petition is dismissed for non-prosecution.
