Judgment
When the matter is taken up for hearing, Sri Somavarapu Satyanarayana, learned counsel for the petitioner, irrespective of the grounds urged in the Civil Revision Petition, sought liberty to file an appropriate application before the learned trial Court seeking reopening of the matter for the purpose of examining DW1 who is presently residing in India, and requested a direction to the learned trial Court to consider such application in accordance with law. He, accordingly, prayed that the Civil Revision Petition may be disposed of.
Having regard to the aforesaid submissions made by the learned counsel for the petitioner and without going into the merits of the case, this Civil Revision Petition is disposed of. granting liberty to the petitioner to file an appropriate application before the learned trial Court seeking reopening of the matter for the purpose of examining DW1, who is presently residing in India. In the event of such application being filed, the learned trial Court shall consider the same on its own merits and in accordance with law and dispose of the same as expeditiously as possible. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any, pending shall stand closed.
