Judgment
Battu Devanand, J
1) Heard learned counsel for the petitioner and the learned Government Pleader appearing for the respondents and perused the material available on record.
2) Both the counsel agreed that in identical circumstances, this Court disposed of number of Writ Petitions in similar set of facts of this Writ Petition.
3) Accordingly, this Writ Petition is allowed with the following directions:
i) The condition imposed by the respondent No.2 vide proceeding in C.No.209/SEB-KUR/2022, Kurnool, dated 05.08.2022, is set aside.
ii) The respondents are directed to release the seized vehicle for interim custody of the petitioner by taking collateral security of the property situated in the State of Andhra Pradesh equivalent to the value of the said vehicle from the petitioner.
iii) The petitioner is directed not to alienate the vehicle or change the physical features or create any encumbrance on the said vehicle.
iv) The petitioner shall produce the Vehicle whenever it is required by the concerned authorities during pendency of the proceedings before them.
4) There shall be no order as to costs.
As a sequel, miscellaneous petitions, if any pending, shall stand closed.
