(As per Hon’ble Mr. Manish Garg, Judicial Member)

MA/297/2026 filed for joining together is allowed for the reasons stated therein. Registry is directed to number the O.A.

2.

The instant O.A. is filed by the applicants seeking the following relief:

“In view of the facts mentioned above, the Applicants pray that this Hon’ble Tribunal may be pleased to, in view of the above facts and in the interest of justice, call for the records pertaining to the proceedings issued in No. SCR/P-SC/170(a)/W3/EE/Lat.Ind/2025 dated 20.5.2026 issued by the respondent No. 3 wherein the respondents have allowed and shortlisted the respondents 4 to 7, who were appointed under LARGESS Scheme (Liberalized Active Retirement Scheme for Guaranteed Employment for Safety Staff) and working in Engineering department for induction to Assistant Categories in Level 1 of the 7th CPC Pay Matrix in Mechanical, Electrical, Traffic and S&T Departments of SC Division against their undertaking given at the time of their appointment that they will not seek change of department and preparing the select list by charging the Reserved category to the vacancies meant for UR and declare the same is contrary to their undertaking given at the time of appointments as well as contrary to law declared by the Hon’ble Apex Court and the said action is illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India and set aside the same;

ii) Consequently, it is prayed that the Respondents 1 to 3 may be directed to consider and appoint the applicants under 10% lateral induction scheme as per notification with all consequential benefits; and

iii) and to pass such other order or orders as deemed fit and proper in the circumstances of the case.”

3.

Learned counsel for the applicants submits that the applicants, who are Trackmen, working in the Engineering department of South Central Railway, challenge the short list dated 20.05.2026 issued for the 10% lateral induction into Assistant categories in Mechanical, Electrical, Traffic and S&T Departments. They contend that Respondents No.4 to 7, who were appointed under the LARGESS scheme in 2012 after giving a specific undertaking that they would not seek any change of department, have been wrongly shortlisted in violation of that undertaking, the LARGESS guidelines and the law declared by the Hon’ble Supreme Court, thereby illegally depriving the applicants of their legitimate claim for appointment under the 10% lateral induction.

4.

It has been highlighted during the course of the admission hearing that the representations dated 16.06.2026 and 24.06.2026 submitted by the applicants are pending with the competent authority.

5.

In view of the above, the O.A. is disposed of at the admission stage, with a direction to the respondents to dispose of the representations dated 16.06.2026 & 24.06.2026 of the applicants by a reasoned and speaking order, following the principles of natural justice and in accordance with law, within thirty (30) days from the date of receipt of the order. The contents of the O.A. may also be treated as representation from the applicants in addition to the representations dated 16.06.2026 & 24.06.2026. It is needless to mention that we have not entered into the merits of the case. All pending MAs, if any, are also disposed of. No order as to costs.
