Smt.Farha Fathima, learned Standing counsel accepts notice for respondent.

The petitioner is seeking for the following reliefs:-

“(i) Issue a writ in the nature of mandamus directing the respondent to consider the case of the petitioner college as same is ready for inspection as per the calendar of events issued by the respondent herein;

(ii) Issue a writ of mandamus directing the respondent that the admissions had to be made for the academic year 2021-22 as is same has to be inspected and recommended to the state government at the earliest;

(iii) Issue any writ or order as deemed fit in the facts and circumstance of the case in the interest of justice and equity.”

The learned counsel for the petitioner submits that as per Annexure ’B’ to the writ petition, the petitioner has submitted an application seeking affiliation for the academic year 2021-22 to start a fresh course in B.Sc., Nursing. The said application was submitted on 08-10-2021. The learned counsel further submits that the petitioner has provided infrastructure facility and it is ready for inspection. The petitioner has made one more representation on 21-01-2022 requesting the respondent to expedite the process of consideration on account of the last date of admission falling on 07-04-2022. He, therefore, prays that an appropriate direction may be issued to the respondent to make inspection and thereafter take a decision to grant affiliation/permission to the petitioner to commence fresh course of B.Sc., Nursing for the academic year 2021-2022. He submits that on account of delay in taking decision by the respondent, the last date for admission falling on 07-04-2022 has also expired very recently.

Learned counsel for the respondent Mrs.Farah Fathima, has taken notice in the matter. She submits that the respondent would take all expeditious steps to take a final decision on the application filed by the petitioner seeking affiliation.

Since only a mandamus is sought for by the petitioner for considering the application seeking affiliation, this petition is disposed of with a direction to the respondent to consider the case of the petitioner College for commencing B.Sc., Nursing Course for the academic year 2021-2022 as per the application at Annexure-B to the writ petition, within ten days from today and communicate its decision to the petitioner immediately thereafter with relevant reasons.
