The Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the impugned order passed by the 2nd respondent in RC.DICS/389/2015 dated 25.02.2015 as illegal, arbitrary and consequently direct the respondents to continue the petitioner as fair price shop dealer of shop no.8 of Kesepalli Village, Narpala Mandal, Anantapuram District.
Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.
Considering the submissions and on perusal of the record, this Court has passed interim order on 12.3.2015 as follows:
…Since the charges levelled against the petitioner are vague and general, based on which, the impugned order was passed, there shall be interim suspension of the impugned order dated 25.02.2015 passed by the 2nd respondent.”
After 12.3.2015 the case was listed on this day i.e. on 06.3.2023 and both parties have agreed for disposal of the writ petition, with a direction.
In view of the above interim orders, the respondents are directed to conclude the final proceedings and take appropriate action against the petitioner, if the petitioner is continuing as fair price shop dealer. Till such time, the respondents are directed not to take any coercive steps against the petitioner.
Accordingly, the writ petition is disposed of. No costs.
As a sequel miscellaneous applications, pending, if any, shall also stand closed.
