Judgment
Alleging inaction of respondents No.3 and 4 in conducting a fair and effective investigation in crime No.337 of 2025 on the file of Geesugonda Police Station, Warangal District, this writ petition has been filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home, appearing for respondents No.1 to 4.
The learned counsel for the petitioner submitted that the petitioner is the wife of the deceased, late Lyadella Raju, who was found dead with certain injuries on his body. A case in Crime No.337 of 2025, dated 19.10.2025, has been registered. It is submitted that the respondent police, relying upon the final opinion furnished by the Assistant Professor, Forensic Medicine & Toxicology, Kakatiya Medical College, Hanumakonda, to the effect that the death of the person was due to sudden cardiac arrest and was a natural death, have closed the case. Aggrieved thereby, this writ petition is filed.
The learned counsel for the petitioner has drawn the attention of this Court to the photographs filed at page Nos.34 and 35 to demonstrate that there were injury marks on the body of the deceased and, therefore, according to the learned counsel, the death could not have been treated as a natural death.
The learned Assistant Government Pleader for Home has filed a memo dated 07.07.2026, enclosing a copy of the final report and also the letter addressed by the Assistant Commissioner of Police, Parkal, to the Assistant Professor, Forensic Department, Toxicology, KMC, Warangal seeking an opinion on the allegations made by the petitioner. The injuries found on the body of the deceased were also referred to in the said letter and the forensic expert was requested to furnish a point-wise clarification on each of the issues.
The letter of the Assistant Professor to the Assistant Commissioner of Police, Parkal, furnishing clarification to the letter of the Assistant Commissioner of Police, is also enclosed and therein it is reiterated that the death is due to sudden cardiac arrest. However, this Court finds that there is no point wise clarification as requested by the Assistant Commissioner of Police. Having perused the photographs filed by the petitioner and the post-mortem report, which refers to the injury marks found on the body of the deceased, this Court is of the opinion that a fresh opinion has to be called for from an officer higher in rank than the officer who has earlier furnished the opinion.
The learned Assistant Government Pleader for Home submits that the Head of the Department of Forensic Medicine, Kakatiya Medical College, would be the above the rank to the Assistant Professor who has earlier furnished the opinion.
At this stage, the learned counsel for the petitioner submits that, in order to rule out any kind of prejudice and to ensure a fair and impartial opinion, a direction may be given to obtain an opinion from the Head of the Department of Forensic Medicine of either Gandhi Hospital or Osmania General Hospital.
Having regard to the rival contentions, this Court directs respondent No.3 to address a letter to the Head of the Department of Forensic Medicine, Osmania General Hospital, Hyderabad, along with all the relevant records, including the post-mortem report, photographs and the earlier opinions, and obtain an opinion with regard to the possible cause of death of the deceased. Upon receipt of the said letter, the concerned authority shall examine the relevant material and furnish an appropriate opinion. On receipt of such opinion, the respondent police shall take appropriate further action in accordance with law.
A copy of the opinion furnished by the concerned authority shall also be furnished to the petitioner. The entire exercise of forwarding the relevant records and obtaining the opinion shall be completed within a period of three months from the date of receipt of a copy of this order.
With the above directions, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
