Judgment
Applicant has filed this first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 24/2026 registered at Police Station – Amabeda, District Uttar Bastar Kanker (C.G.) for offence punishable under Section 303(2) and 3(5) of BNS.
Learned State counsel submits that at the time of filing of charge-sheet, other offence punishable under Section 61(2) and 112(2) of BNS is also added which is not forming part of rejection order as also not mentioned in the application.
Learned counsel for applicant submits that in view of objection raised by learned State counsel, he may be permitted to withdraw with application with liberty to file an application for grant of bail afresh before the concerned court below.
In view of above, this application is dismissed as withdrawn with liberty as prayed for.
Registry is directed to return back certified copy of the documents to counsel for applicant after retaining photocopy of the same in record.
