Heard learned counsel representing the petitioner and learned counsel representing the respondents.

The petitioner in this Criminal Writ Petition has prayed to constitute the Special Investigation Team (SIT), or to get the investigation conducted by any independent Agency like Central Bureau of Investigation (CBI) etc, to investigate her complaint.

The petitioner complained that she had received compensation amount in her Account to the tune of Rs.14,90,290/-(Rupees Fourteen Lac Ninety Thousand Two Hundred Ninety) only, but a fraud was committed and the entire amount deposited in her Bank Account, had been withdrawn from her account, for which an F.I.R. has also been instituted, but the Police has not properly investigated.

The F.I.R. has been brought on record at Annexure-3 (page-43) to the writ petition. The F.I.R. has been lodged against one Sonu Kumar and unknown for offences under Sections 316(2), 316(5), 318(4), 336(3), 340(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(1)(p) and 3(1)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act.

It is the grievance of the petitioner that the respondents are not proceeding and are not investigating the matter and whenever she goes to the Police Station, she does not get any cooperation from the police officials.

Learned GA-III submits that the police has investigated and found material evidence against Sonu Kumar. It has been submitted that warrant has already been issued against him on 17.02.2025.

Mr. Abdul Allam, learned senior counsel representing the respondent – Jharkhand Rajya Gramin Bank, submits that they had also found materials against Sonu Kumar.

Considering the aforesaid fact, I am of the opinion that the matter is being investigated properly. Thus, it does not call for appointment of any other Investigating Agency, either SIT or CBI.

Accordingly, this Criminal Writ Petition is dismissed.

If the petitioner is dissatisfied with the investigation and the charge-sheet, it will be open to her to file an appropriate application before the Trial Court.
