Judgment
Ravindra Maithani, J
Applicant is in judicial custody in FIR No. 303 of 2024, under Section 304 (2), 305, 317 (2), 3 (5) of the Bharatiya Nyaya Sanhita, 2023, Police
Station Kunda, District Udham Singh Nagar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
Learned counsel for the applicant would submit that the alleged recovery is false. The applicant has not snatched any mobile.
Learned State counsel would submit that the applicant could be spotted in the lift while entering in the hospital alongwith the co-accused, but as per
the CCTV record, it is the co-accused who snatched the mobile phone.
Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the
satisfaction of the Court concerned.
