Judgment
Ravindra Maithani, J
Applicant Gaurav Saini is in judicial custody in FIR No.797 of 2023, under Sections 394, 427, 34 IPC, Police Station Kotwali Haridwar, District- Haridwar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
According to the FIR, on 25.11.2023, at about 4:30 in the evening, when the informant was walking in the locality, three persons tried to snatch his mobile phone.
Learned counsel for the applicant would submit that it is a false case; there is no evidence against the applicant; nothing was looted and nothing was recovered from the applicant.
On the last occasion, the Court wanted to know from learned State Counsel as to how the applicant was identified. Today, learned State Counsel would submit that there is nothing on record to confirm as to how the applicant was identified.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
