Lila Vati vs State of H.P. and Others

Kurian Joseph, C.J.—The writ petition is filed with the following prayers :

i. The Respondents may very kindly be directed to release the arrears of salary accrued to the applicant on the grant of selection grade as calculated in the service book with penal interest.

ii. That the applicant may also be held entitled for the revised pension on the basis of the revised pay after the grant of selection grade and the arrears of pension accrued to her may also be ordered to be paid with penal interest.

It is seen from the reply that pursuant to order dated 28th May, 1996 of the Director, Primary Education, the Petitioner had been granted the selection grade. It is also submitted that the pay was also accordingly fixed. It is submitted that the Petitioner has since retired from service, the surviving grievance is only with regard to revision of pension on account of revised pay scale. The Petitioner having been granted the revised pay scale, the pension has to be fixed accordingly. If that has not been done so far, there will be direction to the second Respondent to take appropriate action in the light of this judgment within a period of three months from the date of production of the copy of this 2 judgment by the Petitioner and disburse the eligible benefits within another one month.

The Writ Petition is disposed of, so also the pending application(s), if any.
