R.K. Merathia, J.—This case has been listed at the request of Mr. Chamaria, learned Counsel appearing for the Respondent, who, referring to supplementary counter affidavit, filed on 18/04/2011, submitted that the Respondent may be permitted to move the Consumer Forum but the delay may be condoned and the case may be decided expeditiously before the Consumer Forum.

Accordingly, the impugned award dated 12/05/2008, passed by the Permanent Lok Adalat, Dhanbad in PLA Case No. 74/2007, is set aside. The Respondent is permitted to move the District Consumer Forum, Dhanbad within two weeks from today alongwith a petition for condonation of delay. The delay will be condoned keeping in view the pendency of this writ petition.

Mr. Sachin Kumar, learned Counsel appearing for the Petitioner submitted that he will instruct the Petitioner to appear in the said case immediately on notice by the Respondent.

After filing the case before the Consumer Forum, the Respondent will serve a copy of the complaint petition etc. to the office of the Petitioner at Dhanbad on which the Petitioner will immediately appear before the Consumer Forum. The Consumer Forum will fix the date(s) and will decide the case after giving opportunity of hearing to the parties and in accordance with law as early as possible and preferably within three months from the date of filing of the complaint petition. The parties are directed to cooperate in early disposal of the case.

With these observations and directions, this writ petition stands disposed of.
