Judgment

This O.P.(Crl.) is preferred by the accused No.2 in C.C.No.4/2021 pending before the Special/CBI Court, Thiruvananthapuram. The petitioner is aggrieved by Condition no.2 imposed in Ext.P4 order, which is to the effect that the petitioner shall furnish bank guarantee for Rs.10 lakhs before the Court within fifteen days, which pre-condition is added to enable the petitioner to visit Portugal in connection with his business.
Heard Sri.M.V.S.Nampoothiry, learned counsel for the petitioner and Sri.Sreelal N. Warrier, learned Special Public Prosecutor for Central Bureau of Investigation. Perused the records.
Having heard the respective counsel, this Court is of the opinion that the condition imposed is not liable to be interfered as such, inasmuch as the same seems to be incorporated so as to ensure the availability of the petitioner/accused no.2 at the time of trial. However, the quantum of bank guarantee, which has been directed to be furnished can be reduced, without mitigating the interests of the prosecution.
In the circumstances, the stipulation in condition no.2 to provide bank guarantee for Rs.10 lakhs is reduced to Rs.6 lakhs. That apart, the time stipulated for providing the same vide Condition no.2, that is to say, fifteen days from the date of the order is also extended to fifteen days from today.
With the above referred two directions with respect to Condition no.2, this O.P.(Crl.) will stand disposed of.
