Judgment
I.P. Singh, J.—Heard. This application has been filed for quashing the order dated 11.7.1995 passed by Judicial Magistrate, 1st Class, Ara in G.R. No. 327 of 1985 (Trial No. 520 of 2000) by which he has been pleased to cancel the bail of the petitioner and non-bailable warrant of arrest has been issued against her.
It has been submitted that some one had with mala fide intention fixed the thumb impression of the petitioner on the vakalatnama for the reasons known to her/ him and filed the same alongwith bail petition before the learned Magistrate which was never executed by her nor she had put her thumb impression on vakalatnama (annexure-3). It has also been submitted that the petitioner was on duty on 14.9.1993 in Jain College, Ara and she has also produced the attendance certificate granted by the Principal of the College issued on 22.10.1995 (annexure-5) and accordingly to her she had no knowledge about the order of the court.
In view of above, the petitioner is directed to surrender before the court below and pray for bail which will be considered and disposed of on merit. This application is accordingly disposed of.
