The lawyers have no objection with regard to the proceeding, which has been held through video conferencing today at 11:00 A.M. They have no complaint in respect of the audio and video clarity and quality.

Defect as pointed out by the office is ignored for the present. Heard the counsel for the parties.

The petitioner is an accused for the offence punishable under Section(s) 341, 323, 307, 504, 506, 302 and 34 of the Indian Penal Code.

From the FIR, it appears that the dispute arose between the parties, when a hen of the petitioner entered in the field of the informant which was driven out by the wife of the informant. A verbal altercation took place between the parties, but the petitioner is alleged to have assaulted the husband of the informant, resulting the injuries upon him. The case was initially instituted under Section 307 IPC and as well as other sections of the Indian penal Code. After 7 days, the deceased died and therefore, Section 302 IPC has been added in this case.

Learned A.P.P opposes the prayer for bail of the petitioner. Considering the nature of allegation as well as the manner of assault, which was made, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Latehar, in connection with Manika P.S. Case No. 04/2020.
