This matter was referred to mediation by order dated 04-10-2024. It appears that the mediation proceedings are successful and the report of the Mediator has been filed before this Court on 05-11-2024.

Perused the terms arrived at, and the same is also shown to the learned counsel appearing for the parties. The learned counsels, though agreeable to the terms as arrived at between the parties, however, submits that the only point left out is with regard to the three impugned orders passed by the respondent No. 5 Dorbar. To this, Mr. J.Shylla, learned counsel appearing for the respondent No. 5 Dorbar, submits that in view of the mutual settlement arrived at, the orders will be withdrawn.

Accordingly, the terms as contained in the mediation proceedings is hereby made an order of this Court and are reproduced herein below:

“All the parties are present today at the Meghalaya High Court Conference Room on the 5th November, 2024 agreed to the terms and conditions as laid down by both the parties that both the Petitioner and the Respondent which are as followed:-

1.

That the Petitioner should abide by all the village rules and regulation.

2.

That the Petitioner must cooperate with the Sordar of the village and the Executive Committee which has been elected by the member of the village.

3.

That the Petitioner must maintain cordial relationship with everyone in the village and that the petitioners needs to take part in all village gathering and activities.

4.

That the money of the VO must be returned which was in the possession of Smt. Blestina Nongsiej.

5.

The village of Mawmluh II admitted that no important documents like Epic, Ration card, Adhaar card etc. were withheld and undertakes that no such documents shall be withheld in the future.

6.

That both the parties agreed not to use any abusive language towards each other in order to maintain peace and harmony in the village.

7.

That no one in the village should be deprived of any public benefits such as government schemes etc. as there were no such instances earlier.

8.

That both the parties hereby undertake that all pending cases / FIR / Orders lodge by both the parties shall be withdrawn as settled.

Further, the district administration shall take necessary steps on assessing the situation with regard to the withdrawal of Police personnel from the village.
