Judgment
The appellant filed S.A. bearing No.223/2026 titled as Kusumlata V. ICICI Bank Limited which is stated to be pending before DRT-II, Chandigarh. The appellant filed an application bearing I.A. No. 709/2026 for grant of interim relief as well as on the point of limitation. The application bearing I.A. No.709/2026 was ordered to be dismissed vide impugned order dated 12.06.2026 by holding that S.A. is barred by limitation. The appellant being aggrieved filed the present appeal. 2.Sh. Rahul Garg, Advocate for respondent stated that at present the appellants have availed two loan facilities and, in both loans, there is outstanding dues of Rs.12 lakhs and about 50 lakhs approximately. The outstanding dues in respect of property subject matter of present appeal is about Rs.12 lakhs. 3.Sh. Amit Gaurav Singh, Advocate for the appellants, on instruction stated that the appellants shall deposit Rs.12 lakhs which are stated to be outstanding in respect of Loan Account No. LBPNP00005242383 within a week from today and till next date of hearing let the possession of the subject property may be protected. 4.Sh. Rahul Garg, Advocate for the respondent also stated that if the appellants deposit Rs.12 lakhs within a week from today then the respondent shall not take the possession of the subject property bearing No. 141/8120 share of land Rakba 2 Bigha 18 Biswa i.e. 1 Biswa, admeasuring an area of 50 sq. yards, comprised in Khewat No. 1050, Khasra No. 2671/2/2 (2-18) Min Dar, situated at Patti Rajputan, Dar Abadi New Model Town, within limits of M.C. Panipat-132103, Haryana.
In view of the submissions made by the respective counsels for the parties, the appellants are directed to deposit a sum of Rs.12 lakhs on or before 20.08.2026 with the respondent and the respondent shall maintain the status-quo regarding the title and possession of the subject property bearing No.141/8120 share of land Rakba 2 Bigha 18 Biswa i.e. 1 Biswa, admeasuring an area of 50 sq. yards, comprised in Khewat No. 1050, Khasra No. 2671/2/2 (2-18) Min Dar, situated at Patti Rajputan, Dar Abadi New Model Town, within limits of M.C. Panipat-132103, Haryana.
However, it is made clear that if the appellants failed to deposit Rs.12 lakhs on or before 20.08.2026 in that eventuality the respondent shall be at liberty to proceed in accordance with law.
