The present appeal is filed to impugn the order dated 01.07.2026 passed in S.A. bearing No. 580/2023 titled as Sarita Kaushik & others v. Bank of Baroda passed by DRT-I, Delhi whereby I.A. bearing No. 1538/2026 filed by the appellants was dismissed.

Due to the efforts made by this Tribunal both parties have agreed to settle their pending dispute. Sh. Pratyush Parimal, Counsel for the respondent bank, on instruction, from Sh. Saroj Kumar, Chief Manager stated that at about Rs.46.00 lacs is pending against the appellants as on today and the loan was against the secured asset. However, it is further stated that if the appellants pay Rs. 35.00 lacs towards full and final settlement to the outstanding dues on or before 31.07.2026 then, the respondent i.e. Bank of Baroda shall settled with the appellant and shall not proceed with the auction of the secured asset bearing No. G-4, Khasra No.539/311 of village Uldhanpur, Block-G, Colony Security known as Naveen Shahdara, Delhi-110032.

Sh. Anand Aggarwal (VC) and Sh. Anjaneya Mishra, Counsels for the appellants, on instruction from the appellants no.1 and 2 who are present today stated that the appellants shall pay Rs.35.00 lacs to the respondent bank on or before 31.07.2026 towards full and final satisfaction of loan account.

Accordingly, in view of the submissions made herein above, the appellants are directed to pay Rs.35.00 lacs to the respondent bank towards full and final satisfaction of their loan account on or before 31.07.2026. Till then, the respondent bank i.e. Bank of Baroda shall not take any coercive action regarding the auction of the subject property bearing No. G-4, Khasra No.539/311 of village Uldhanpur, Block-G, Colony Security known as Naveen Shahdara, Delhi-110032. However, it is made clear that in case of default on the part of the appellant, the respondent shall be at liberty to initiate appropriate legal proceeding including the auction of the subject property in accordance with law.

After receipt of the said amount, the respondent bank i.e. Bank of Baroda shall issue 'No Dues Certificate' and shall also returned back the 'Original Title Documents' of the subject property to the appellants in accordance with law.

With these observations, the present appeal stands disposed of along with pending application, if any.
