Judgment

The applicant is working as Junior Intelligence Officer (JIO) in Intelligence Bureau of Ministry of Home Affairs. Through an order dated 18.03.2020, he was transferred to SIB, Kohima. On a representation submitted by him for retaining him at Delhi by mentioning the medical and family problems, the concerned authority modified the order of transfer and posted him in the station at SIB, Varanasi. Thereafter, the applicant made representation dated 15.04.2020 with a request to post him in the hometown at Jammu/Srinagar. This OA is filed with a prayer to direct the respondents to retain the applicant at Delhi or transfer him to Jammu/Srinagar.
The applicant contends that it would be difficult for him to function at Varanasi. It is stated that he has an old aged mother and that it would be difficult for him to procure the accommodation at Varanasi.
We heard Mr. Navneet Kumar, learned counsel for applicant and Mr. S.M. Zulfiqar Alam, learned counsel for respondents at the stage of admission through video conferencing.
The initial transfer of the applicant was to SIB, Kohima. On a request made by him for transfer, his place of posting was changed to SIB Varanasi. It may be true that the applicant would prefer to be posted at his hometown at Jammu/Srinagar. However, by the very nature of post, the respondents have to choose such a location where the discharge of the duties would be in accordance with the prescribed norms.
We do not find any ground to interfere with the order of transfer, much less to direct the respondents to post the applicant to native place. The O.A is accordingly dismissed.
M.A. No. 1522/2020 stands disposed of. There shall be no order as to costs.
