HON'BLE Mr. DEVENDRA CHAUDHRY, MEMBER (A) Heard learned counsel for the applicant as well as counsel for the respondents.

At the outset, learned counsel for the applicant pointed out that the matter concerns a type test in which due to alleged fault of the machine, the typed matter was unnecessarily underlined. The same was pointed out by the applicant vide his representation dated 11.02.2020. The applicant accordingly immediately after the examination made a representation in this regard to the respondents to which the respondents stated that the same may be submitted through proper channel. The applicant, thereafter, submitted his representation (Annexure A-7) through proper channel which was received in the Department on 25.08.2020.

Learned counsel for the applicant further states that ends of justice would be served if a direction is given by this Tribunal to the respondents/competent authority to consider and dispose of the pending representation of the applicant within a stipulated period of time. Learned counsel for the respondents has no objection to the same.

In view of the above submissions, respondents /Competent authority is directed to consider and decide the representation of the applicant dated 25.08.2020 (Annexure A-7) by passing a reasoned and speaking order within a period of six weeks from the date of receipt of certified copy of this order, under intimation to the applicant. It is made clear that no comments have been made on the merits of the case.

The OA is disposed of accordingly.
