This appeal is preferred by an operational creditor, who challenges an order dismissing his petition under Section 9. The learned counsel for the appellant submits that, the corporate debtor has been admitted to CIRP vide order of the Adjudicating Authority (NCLT, Division Bench (Court-1) Chennai) in CP(IB)/49(CHE)/2023 dated 16.07.2026.

He added, in view of the same, he is not pressing this appeal but required that the appellant may be given liberty to revive the appeal in the eventuality of this tribunal allowing any appeal that might be preferred against the order in CP(IB)/49(CHE)/2023.
