The brief facts of the case are that the applicant is seeking pay fixation at par with his junior. The applicant though was selected earlier, but actual appointment was given in the year 2005. His grievance is that his junior is getting more pay than him. The respondents had applied the principle of stepping up of pay and rejected the case of the applicant, whereas his case is that he should have been considered for appointment to the post of Pharmacist/Dispenser from the date he got selection. His case has already been recommended by the Delhi Subordinate Services Selection Board (DSSSB) which is relied upon by the counsel at page 28.
On the contrary, learned counsel for the respondents, Ms. Esha Mazumdar needs some time to seek instructions.
This is a simple case of parity. Respondents may take call on this matter and dispose of the same within a period of eight weeks from the date of receipt of copy of this order. If the applicant is still not satisfied, he may re-approach this Tribunal.
With this observation, the OA is disposed of. No costs.
