Application is registered based on a complaint received by post/e-mail
This original application has been registered under Section 14 & 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 18.08.2022 received from Sh. KRM Reddy, R/o 1163, 5th Main, 7th Sector, HSR Layout, Bengaluru-560102.
The complaint is that Director, Mines and Geology, Andhra Pradesh has issued Memo No. 3861432/P/2020 dated 16.07.2021 providing that approval of mining plan shall be the primary step in the process of issue of mining license.
The complaint is that the above procedure is reverse and without first examining the eligibility of applicant and desirability of grant of license, the said process is not valid and contrary to provisions of Mines and Minerals (Development and Regulation) Act, 1957 and the rules framed thereunder. It also said that in case such mining license are issued, there is every apprehension that it may cause some damage to the forest land.
The application basically raises a grievance against letter of Director of Mines which is in respect of grant of mining license and no facts are disclosed to show that there is any fctual or possible loss to environment in one or the other way.
In this view of matter, we do not find any substantial question relating to environment arising due to implementation of Scheduled Enactments under NGT Act, 2010.
The application is accordingly rejected.
