Judgment
The present appeal has been filed under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Heard learned counsel for the appellant, learned counsel for the State and the learned counsel for the respondent No.2.
The appeal has been filed against the impugned order dated 13.03.2026 in M.C.A. Case No.430 of 2026 (SC/ST Case No.31 of 2025) passed by the learned Additional Sessions Judge-VI-cum-Special Judge SC/ST Cases, Hazaribagh in connection with SC/ST P.S. Case No.02 of 2023, registered for the offence under Sections 147, 149, 323, 341, 448, 504 and 506 of the Indian Penal Code and under Section 3(1)(s) & 3(1)(zc) of the SC/ST (PoA) Act. The case is presently pending in the court of the learned A.D.J.-VI-cum-Special Judge SC/ST Act Cases, Hazaribagh.
It has been submitted by the learned counsel for the appellant that the investigation is complete. Both the parties have compromised. The appellant undertakes to participate in the trial. He is in custody since 13.03.2026. On the above basis, the prayer for bail has been made.
Learned counsel for the State and the learned counsel for the respondent No.2 have opposed the prayer for bail.
Considering the fact that the investigation is complete, the appellant named above, is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the learned A.D.J.-VI-cum-Special Judge SC/ST Act Cases, Hazaribagh in connection with SC/ST P.S. Case No.02 of 2023, subject to the condition that the appellant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
In the result, the present criminal appeal stands allowed and accordingly, disposed of.
