Mr. S.A.Sheikh, learned counsel for the petitioner today at the outset has submitted that in the said School i.e. Photamati Non-Govt. L.P.School, West Garo Hills, a vacancy has since arisen due to the retirement of the Headmaster. He submits that though this writ petition is directed against the appointment of the respondent No. 6, at this stage, he no longer wishes to pursue the instant writ petition if liberty is given to him for filing of a representation before the Managing Committee for consideration of his candidature.
Mr. K.P.Bhattacharjee, learned GA for the respondents No. 1-4, Ms. E.Thabah, learned counsel for the respondent No. 5 and Mr. S.Deb, learned counsel for the respondent No. 6 have no objection.
Accordingly, the writ petition is disposed of on withdrawal, however, with liberty to the writ petitioner to file a representation before the respondent No. 5 for consideration for appointment against the vacant post in accordance with law.
Matter stands closed and disposed of.
