V.N. Sinha, J.—Heard Learned Counsel for the petitioner and the State. Petitioner has filed this application for a direction to the State respondents specially the Principal, Government Zila School, Ara, Bhojpurto honour his own office order, bearing Memo No. 160 dated 13.9.2003, Annexure-2 whereunder he was allowed settlement of land measuring 10 feet x 8 feet for carrying out his business activity.

Counsel for the petitioner states, which is not disputed by the State Counsel also, although he has fried a counter affidavit duly affirmed by Chandra Mauli Prasad Sharma, Principal, Government Zila School, Ara, Bhojpur that the office order, bearing No. 160 dated 13.9.2003 has neither been recalled nor set aside. As such, unless the order dated 13.9.2003, Annexure-2 is recalled or set aside, the petitioner is welt within his rights to continue his business activity over the lands settled to him under the aforesaid office order, Annexure-2. Let the petitioner be allowed to continue his business activity over the lands settled to him under the aforesaid office order, Annexure-2. This application is disposed of.
