Heard Mr. Girish Chandra Jha, learned counsel appearing on behalf of the petitioner, Mr. Sajid Salim Khan, learned SC-25 for the State and Mr. Bindhyachal Rai, learned counsel for the Accountant General.

The present writ petition has been filed by the petitioner for grant of pay conservation approval from the Principal Secretary, Finance Department, Bihar, Patna so that the pay scale of the petitioner may be regularized.

Learned counsel appearing on behalf of the petitioner submits that the respondents have filed their counter affidavit and supplementary counter affidavit and from Paragraph Nos. 7 and 8 of the supplementary counter affidavit, they have taken steps for redressing the grievance of the petitioner, yet petitioner has not been paid A.C.P.

Mr. Sajid Salim Khan, learned SC-25 appearing on behalf of the State submits that the petitioner has been paid all the retiral dues as prayed for in the present writ petition. If the petitioner is still aggrieved, he may represent before the appropriate authority.

As the main grievance of the petitioner as prayed for in the present writ petition has already been redressed as it would appear from Paragraph Nos. 7 and 8 of the supplementary counter affidavit and to that extent petitioner has admitted the said fact. No rejoinder has been filed in spite of the fact that petitioner was given an opportunity vide order dated 15.03.2023.

Petitioner, if so advised, may file a detailed representation, in case, any other retiral dues still remains to be paid to him. In case, representation is filed before the concerned authority, the same is directed to be disposed of within a period of three months.

Accordingly, the writ petition stands disposed of.
