Judgment
ORDER
(Delivered by Hon’ble Mr. Tarun Shridhar, Member (Administrative)
Shri Suresh Kumar Gupta, learned counsel for the applicant and Shri Chakrapani Vatsyayan, learned counsel for the respondents, are present.
Vide the instant original application, the applicant seeks the following relief:
“ i) To issue an order directing the respondent no. 3 to decide the representation of the applicant dated 27.01.2011 with regard to up-gradation of overall grading for Annual Confidential Report (ACR) of Financial Year 1994-95, 1995-96 and 1996-97 of applicant and also a direction to the respondent no. 2 to decide the representation of applicant dated 20.07.2016 and reminder thereafter dated 13.09.2017 pending before him and to promote the applicant in accordance with law by constituting review Departmental Promotion Committee (DPC).
ii) To issue any other order or direction as this Hon’ble Tribunal may deem fit and proper in the circumstances of the case.
iii) To award costs through out to the applicant.”
Shri Suresh Kumar Gupta, learned counsel for the applicant submits that the applicant’s representation with respect to the overall grading and assessment made in his Annual Confidential Reports (ACR) for the year 1994-95, 1995-96 and 1996-97 has been decided by the Competent Authority vide order dated 15.02.2022. He submits that the Competent Authority has upgraded the overall grading of the applicant in these ACRs from ‘Good’ to ‘Very Good’ and hence part of his grievance stands addressed. Now, the only issue which remains is that pursuant to the upgradation of the ACRs, the applicant should be given the benefit of promotion by way of convening a meeting of the Departmental Promotion Committee (DPC) to review its decisions taken at the appropriate times when the applicant was denied the benefit of promotion on account of not meeting the benchmark due to the grading of ‘Good’ in his ACRs. Shri Chakrapani Vatsyayan submits that he has taken instructions from the respondents with respect to the Order dated 15.02.2022 and mentions that he would like to file a comprehensive reply to the original application, we feel that now, in view of the very limited issue which remains in the present O.A, there would be little reason to keep this original application pending. Accordingly, it is disposed of with a direction to the Competent Authority amongst the respondents to take further consequential action subsequent to the upgradation of the ACRs of the applicant and consider convening a review Departmental Promotion Committee (DPC) for consideration of the claim of the applicant for promotion. The aforesaid O.A. is disposed of with these directions which should be complied with within a period of twelve weeks from the date of this order.
With the above terms, Original Application No. 330/01091/2021 is disposed of.

There shall be no order as to costs.
