Judgment
ORDER:
Criminal Revision Case has been filed challenging the order passed by the learned I Additional District and Sessions Judge-cum-Special Judge for Trial of Offences under the NDPS Act, Visakhapatnam1 in Crl.M.P.No.630 of 2026 in Cr.No.06/2026 of Annavaram Police Station on 10.08.2026 extending the period of remand up to 230 days from the day the Petitioners/Accused Nos.1 & 3 were remanded to judicial custody for the first time.
Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record.
As seen from the record, the learned Sessions Judge, by way of the impugned order, has extended the period of remand from 180 days to 230 days. The Petitioners have already endured incarceration for more than 220 days in judicial custody, notwithstanding the fact that the alleged contraband seized is only 23.5 kilograms of ganja and that no material whatsoever has been placed on record to indicate the existence of any criminal antecedents or involvement in similar offences. It is further noteworthy that the Petitioners are young individuals aged about 20 and 21 years, respectively, standing at a formative and impressionable stage of life. The grounds assigned for extension of the period of investigation are not convincing and reasonable. So, the consequential remand is held unsustainable.
The Criminal Revision Case is allowed with the following conditions:
The Petitioners/Accused Nos.1 & 3 shall be enlarged on bail subject to them executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties each for the like sum each to the satisfaction of the learned I Additional District & Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam.
The Petitioners/Accused Nos.1 & 3 shall appear before the Station House Officer, Annavaram Police Station, Alluri Sitharama Raju District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court.
The Petitioners/Accused Nos.1 & 3 shall not leave the limits of the District without prior permission from the Station House Officer concerned.
The Petitioners/Accused Nos.1 & 3 shall not commit or indulge in commission of any offence in future.
The Petitioners/Accused Nos.1 & 3 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating officer as and when required.
The Petitioners/Accused Nos.1 & 3 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer.
The Petitioners/Accused Nos.1 & 3 shall surrender their passports, if any, to the investigating officer. If they claim that they do not have a passport, they shall submit an affidavit to that effect to the Investigating Officer.
With the above observations and directions, this Criminal Revision Case is allowed.
As a sequel, interlocutory applications, if any pending, shall stand closed.
