Heard Mr. Ram Hriday Prasad, learned Advocate for the petitioner and Mr. Bijay Bhushan Prasad, learned Advocate for the State.

The petitioner has invoked the jurisdiction of this Court seeking a direction upon the concerned respondents to ensure payment of arrears of salary with effect from 01.07.2023, besides other consequential benefits.

Learned Advocate for the petitioner adverting to the materials available on record submitted that the salary of the petitioner was held up on account of non handing over of the charge of pending cases to the concerned SHO, however, subsequent thereto, the petitioner, in pursuance of the order of the higher authorities reached out the SHO of the concerned Police Station and handed over the charge(s) of all the pending cases. To support the aforesaid contention, attention of this Court has been drawn to paragraph nos. 12, 13 and 14, besides the list of pending cases and representation, which clearly reveal the charge of all the pending cases duly handed over to the SHO, Daudnagar and SHO, Navinagar on different dates. At present, in the submission of the petitioner, there is no pending cases with the petitioner of which charge is required to be handed over. Despite the aforesaid fact, neither salary of the petitioner has been started nor the petitioner has been extended the arrears of salary for the period with effect from 01.07.2023 till date.

Learned Advocate for the State prays for a short adjournment to apprise this Court with regard to the present position.

Considering the submissions and the materials available on record as also the nature of the grievance, this Court directs the petitioner to file a fresh representation along with the relevant materials and fact before the Inspector General of Police, Magadh Range, Gayaji, preferably within a period of two weeks from today. In case such representation is filed by the petitioner, the Inspector General of Police, Magadh Range, Gayaji shall call for the report and on being satisfied that the charge of pending cases has already been handed over to the respective SHOs., direct for the consequential order of salary and its arrears, preferably within a further period of eight weeks, if there is no legal and administrative impediment otherwise.

The writ petition stands disposed off with the aforesaid direction.
