The petitioner in this Public Interest Litigation is a Chartered Accountant. He is primarily seeking a direction to further extend the cut-off date prescribed in General Circular No.12/20 dated 30.03.2020 issued by the Government of India, Ministry of Corporate Affairs, which was extended by General Circular No.30/2020 dated 28.09.2020 till 31.12.2020, to give benefit to the beneficiaries and not to disqualify the Directors who have not made compliance in the terms of the aforesaid Circulars.
When the case came up for consideration on 21.01.2021, we had posed a question to Mr. P. Bhaskar, learned counsel for the petitioner, as to whether this Public Interest Litigation would be maintainable at the instance of the petitioner, when beneficiaries, who were directly aggrieved, have not chosen to approach the Court seeking redressal of grievances, if any. On the request made by the learned counsel, the matter is listed today.
Today, learned counsel for the petitioner has submitted that, on instructions from the petitioner, he would like to withdraw the present Public Interest Litigation.
Though the petition is styled as Public Interest Litigation, for the reasons mentioned above, we are inclined to permit the petitioner to withdraw the petition.
Permission is accorded.
Accordingly, this Writ Petition (Public Interest Litigation) is dismissed as withdrawn. No costs. Pending miscellaneous applications, if any, shall stand closed.
