The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 and 506(ii) of IPC, in Crime No.Not Known of 2025, seek anticipatory bail.
The case of the prosecution is that the defacto complainant had lent money to the first petitioner on several occasions for the development of his business, and that petitioners 2 and 3 had also given assurance on behalf of the first petitioner for the repayment of the said loan amount. Hence, the complaint.
The learned counsel appearing for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.
The learned Government Advocate (Crl. Side) appearing for the respondent Police submits that, by an earlier order dated 02.09.2025, this Court had directed the petitioners to appear before the Mediation Centre, however, they failed to appear.
Considering the facts and circumstances of the case, and since this Court had already granted an interim order directing the petitioners to appear before the Mediation Centre attached to this Court, but they failed to comply with the said direction, this Court is not inclined to grant anticipatory bail to the petitioners.
Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition stands closed.
