Judgment
Heard the learned counsels appearing for the parties and perused the documents on record.
Case-diary and copy of the post-mortem examination report have been received in the Court.
The petitioner is an accused in Kandra P.S. Case No.13 of 2017, registered for the offence under Sections 498, 302 & 34 of the IPC, however, now a charge-sheet has been filed only against the petitioner for the offence under Section 306 and 498A of the IPC . Against other co-accused persons, a final form under Section 169 Cr.P.C . has been submitted. The doctor who conducted post-mortem examination over the dead body of the deceased has opined that death has occurred due to asphyxia as a result of hanging. The petitioner is in judicial custody since 04.03.2017.
The learned A.P.P. has opposed the prayer for grant of bail. Having regard to the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Seraikella in connection with Kandra P.S. Case No. 13/2017 corresponding to G.R. No.245/2017.
The instant application is allowed. Let a copy of the order be transmitted to the trial Court through ''Fax''.
