Judgment

The petitioner is arraiigned as Accused No.1 in Crime No. 34 of 2024 at Pedabayulu Police Station, Visakhapatnam District, registered under Sections 20(b)(ii)(C) read with 8(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act).
It is submitted by the learned counsel for the petitioneer that the petitioner was apprehended on 15.07.2024 when the police found the petitioner attempting to repack 150 kilograms of ganja in three white plastic ganja bags and the petitioner was remanded to judicial custody on the same day.
It is submitted that, as of today, 191 days of judicial custody have passed and that the police have not yet filed the charge sheet. It is further submitted that the petitioner is entitled for statutory bail, as police have not filed the charge sheet within the prescribed period.
The learned Assistant Public Prosecutor submits that the investigation is complete and the charge sheet will be filed shortly.
Considering the same, this Court is inclined to grant bail to the petitioner in the event of his arrest, subject to the following condition:-
i) The petitioner shall enlarge on bail in the event of his arrest upon furnishing a personal bond for Rs.50,000/- (Rupees Fifty Thousand only), along with two sureties for a like sum, to the satisfaction of the I Additional District and Sessions Judge-Cum-Special Judge for the trial of offences under the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act), Visakhapatnam.
With the above condition, the criminal petition is allowed.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
