Appellant Nos.2 and 3 are present before this Court and they have been identified by Sri D.Vamsi Krishna, learned counsel appearing on behalf of Sri N.Ashwani Kumar, learned counsel for the appellants. The respondent is also present in the Court and she is identified by Sri Marri Venkata Ramana, learned counsel appearing for the respondent.

The respondent herein had filed O.S.No.860 of 2012 before the Principal Senior Civil Judge's Court, Vijayawada seeking cancellation of deeds revoking certain gift deeds, which had been executed earlier. This suit was allowed, by way of a Judgment and Decree dated 23.06.2014. Aggrieved by the same, appellant Nos.1 and 2 had filed the present appeal. The appellant No.1 had passed away in the course of pendency of the appeal and appellant No.3 has now been brought on record, as the legal representative of the 1st appellant.

During the pendency of the appeal, it is stated that the appellants and the respondent have arrived at a compromise and the terms of settlement are reduced into writing in the form of memorandum of understanding and the same is filed along with I.A.No.1 of 2021 with a request to record the compromise and dispose of the appeal suit in terms of the said memorandum of understanding. As the memorandum of understanding dated 13.10.2021, was executed between the 2nd appellant and the respondent, the 3rd appellant has been shown the said memorandum of understanding and agrees to abide by the said memorandum of understanding.

All the parties before the Court pray that the present appeal be disposed in terms of memorandum of understanding dated 13.10.2021.

Accordingly, I.A.No.1 of 2021 is allowed and the appeal suit is disposed of in terms of memorandum of understanding dated 13.10.2021. The memorandum of understanding shall form part of the decree.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
