Petitioner is working as Master in respondent department and was posted in Gurez. Petitioner''s minor daughter is stated to be suffering from

congenital hand deformity and is under regular treatment and check-up of SKIMS, Soura, Srinagar. Since Gurez remains cut off from rest of the

Valley for about more than five months, according to petitioner, it is not possible for her to provide proper medical care to her daughter, therefore,

she moved an application for her transfer from Gurez to Budgam/Srinagar, which was sympathetically considered by respondents. However,

instead of transferring her on regular basis, petitioner has been deployed for six months in Government Higher Secondary School, Wathoora,

Budgam, which is completing by the end of this month. Petitioner claims to have made another representation to respondents seeking her regular

transfer on account of holding Divisional Cadre post, which has not been considered till date, forcing her to file instant writ petition.

Learned counsel for petitioner states that petitioner would feel satisfied in the event writ petition is disposed of and respondents are directed to

consider the representation of petitioner for her regular transfer to District Budgam/Srinagar and till the representation is considered, she be

allowed to perform her duties in Higher Secondary School, Wathoora, Budgam. To this, learned counsel for respondents states that petitioner''s

case would be considered in strict accordance with rules governing the field.

Writ petition, in view of grounds urged coupled with submissions made by learned counsel for parties, is disposed of with a direction to

respondents to consider and decide the representation contended to have been filed by petitioner, within a period of ten days from the date

certified copy of this order is served upon respondents. Till then status quo as on date be maintained. Disposed of.
