Learned Counsel Mr. Aayog Doshi appeared for the Applicant.
IA No. 372 of 2020 is filed by the RP for withdrawal of the Original Application i.e. CP(IB) No. 175/7/NCLT/AHM/2017, after admission under Section 12(a) of the IBC, 2016.
We heard Learned Counsel for the Committee of Creditors(CoC)/RP.
We perused the record.
The Committee of Creditors(CoC) in its meeting dated 30.06.2020 passed a Resolution with 100% votes for withdrawal of the Original Application, the same is reflected in Clause no. 5 at page no. 36 of the Application. Hence, the IA No. 372 of 2020 is allowed. The Original Application stands withdrawn.
The Corporate Debtor stands discharged from the rigours or CIRP. The RP appears to be paid fees. Hence, the proceeding stands disposed of.
Accordingly, IA No. 372 of 2020 in CP(IB) 175 of 2017 is allowed and stands disposed of.
