Judgment

Heard Mr. S. Dey, learned counsel for the petitioner, who has submitted that an affidavit of service as regard the issuance of notice upon the respondent Nos. 2 & 3 respectively have been filed before this Court, indicating to the extent that the said respondents have received notice as is apparent from the records produced by the post office, however, the said respondents are not in attendance before this Court. Accordingly, the respondent Nos. 2 & 3 are allowed to appear before this Court on the next date fixed, failing which necessary orders may be passed.
Mr. N.D. Chullai, learned AAG has submitted that in course of the proceedings, the Investigating Officer has already filed the charge sheet and on such changed circumstances, this Court would require to look into the materials on record and to decide as to whether the petitioner deserves to be enlarged on bail or not.
On consideration of the submission made, the State respondent is directed to produce the relevant records including the case diary of Mendipathar P.S. Case No. 10 (12) of 2023 under Section 7/8 of the POCSO Act on the next date fixed.
In the meantime, the interim bail granted is to be continued till the next date fixed.
