Judgment

Heard Ms. K. Gurung, learned counsel for the petitioner who has submitted that this Court vide order dated 15.02.2023 has allowed the petitioner to take fresh steps for issuance of notice upon the respondent No. 2/complainant on the ground that the earlier notice issued could not be confirmed whether the same was received or not. However, in the meantime, the learned counsel for the petitioner has confirmed the receipt of the said notice by the respondent No. 2/complainant and has also filed affidavit of service in this regard. It is prayed that this matter may now proceed for hearing.
Upon hearing the learned counsel for the petitioner and also the learned GA for the State respondent, the respondent No. 2 failing to make appearance before this Court today, this Court hereby directs the prosecution to produce the status report as regard the case, wherein the petitioner was involved i.e. Special (POCSO) Case No. 39 of 2020 under Section 366A/34 IPC read with Section 5 (g) (i)/6 of POCSO Act, 2012 pending before the Court of the learned Special Judge (POCSO), West Garo Hills, Tura on the next date fixed.
As prayed for, list this matter on 09.03.2023.
