The Writ petition has been filed for quashing the order dated 05.09.2019 passed in Misc. Case No. 03 of 2019-20 by Respondent No. 6, whereby the petitioner was directed to comply with the order dated 04.01.2019 issued vide Notice Memo No. 14, by which, the petitioner was directed to deposit a sum of Rs. 22,92,530.60/- towards the cost of the foodgrains allotted to the petitioner under the “Total Rural Employment Scheme” within one week, failing which a certificate case would be instituted against the petitioner and further an auction notice would be issued.

Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

During the course of arguments, the Learned counsel for the petitioner contended that the judgment of the Division Bench of this Court in the case of Bhawesh Kumar Bhaskar vs. State of Bihar & Ors. cannot be applied in the present case, as the petitioner was neither a party to the previous Writ petition nor he had approached the Uday Kumar Sinha Committee.

On the other hand, the Learned counsel for the respondents contended that if at all the petitioner has any grievance, he may make a representation before the Deputy Development Commissioner, Sheikhpura, who shall decide the matter.

Therefore, without going into the merits of the case, this Court directs the petitioner to approach the Deputy Development Commissioner, Sheikhpura within a period of one month from the date of receipt of this order. The petitioner shall be at liberty to raise all his pleas, including the plea that no notice was issued to him prior to passing the impugned order. The Deputy Development Commissioner, Sheikhpura shall consider the same and pass a reasoned and speaking order, in accordance with law, within a period of three months thereafter.

With the above said observation, the Writ petition stands disposed of.

Interlocutory application(s), if any, shall also stand disposed of.
