Judgment
ORDER
Mr. Nausher Kohli a/w. Adv. Parag Khondhar, Ld. Counsel for the Respondent is present.
Before rising of this Bench, ld. Counsel for the Corporate Debtor submitted that Corporate Debtor has paid the whole of outstanding money claimed due in the Petition and the Counsel for the Operational Creditor confirms this fact. It is further submitted that an appropriate application under section 12 A of the Code shall be filed before this Bench in couple of days to take out the Corporate Debtor out of CIRP initiated pursuant to the order pronounced in the morning. In view of this fact we consider it appropriate to stay the operation of the order dated 20.08.2024 passed admitting CP 33/2024.
We also direct the Interim Resolution Professional not to take any action pursuant to this order till further orders.
