Judgment

By filing this writ petition, the petitioners have prayed for the following reliefs:-

"(i)

For direction upon the respondents to pay appropriate compensation to the petitioners for their lands used by the respondent authorities for the purpose of running helicopter service between Deoghar - Basukinath for providing Ariel view (हवाई दर्शन ) of Baba Baidyanath Temple and Baba Basukinath Temple.

(ii)

For direction upon the respondent authorities to pay compensation of the land utilized by Kunda Police Station for dumping/parking of seized vehicles over the lands of the petitioners."

Heard learned counsel representing the petitioners and learned counsel representing the respondents.

It is the grievance of the petitioners that the respondents are utilizing the land of the petitioners without their consent for the purpose of running Helicopter service, for providing aerial view of the Temple and also for parking of seized vehicles.

Learned counsel representing the respondent - State, on instruction submits that the State has stopped the operation of Helicopter service and within two days, they will remove all the fencing and other temporary structures, which had been put over the land of the petitioners.

Considering the aforesaid submission, this Writ Petition stands disposed of.

If in future, the respondents want to utilize the land of the petitioners, they must take consent of all the parties and for the period during which they will utilize the land, the land owner should be compensated adequately.
