Judgment
Surjit Singh, J.—Heard and gone through the record.
Present Petitioner, alongwith two other persons, named Raman and Jai Chand, has been booked for offences, under Sections 452, 323, 506, read with Section 34 of the Indian Penal Code, by Nirmand Police.
Prosecution case is that on 7th November, 2010, around 11 p.m., the Petitioner, accompanied by his above-named two accomplices, went to the house of one Tara Chand and all the three assaulted him. Though, the offence is of a serious nature, on account of the Petitioner and his accomplices having committed house trespass, after having made preparation for criminal assault, in the night, yet looking to the submission by the learned Counsel for the Petitioner that the victim of the offence, namely Tara Chand, has compromised with one of the other two accused, namely Raman, and that is why said Raman had withdrawn the application for grant of bail, before arrest, which he moved on 15th November, 2010, I am of the view that ends of justice would be better served in case the present petition is allowed. Consequently, petition is allowed and order of interim bail dated 15th November, 2010 is made absolute.
Petition stands disposed of.
