Judgment
Surjit Singh, J.—Heard and gone through the record.
Present Petitioner and his brothers Sushil Kumar and Rash Pal Singh are alleged to have committed offences, under Sections 341, 323, 307, 325, read with Section 34 of the Indian Penal Code, by assaulting two persons, namely Anil Kumar and Raman Kumar. Anil Kumar was dealt a blow of a strip of wood. As a result of that blow, Anil Kumar sustained an injury dangerous to life and had to be shifted to Amritsar, where he had to be operated upon.
As per police report, quarrel started, all of a sudden, when the injured were present in front of the shop of the Petitioner and his brothers and a cracker had been burst. Petitioner and his brothers felt that Raman Kumar and Anil Kumar were responsible for bursting that cracker and questioned them. In the meanwhile, Sushil Kumar, a brother of the Petitioner, dealt a blow of wooden strip, on the head of Anil Kumar. No role has been attributed to the present Petitioner, in causing injury to Anil Kumar, which has been opined to be dangerous to life. So, his prayer for grant of bail, before arrest, is allowed and the order dated 30th November, 2010, granting interim bail to the Petitioner is made absolute.
