Judgment
Meenakshi Madan Rai, J
Heard on I.A. No.01 of 2021 which is an application filed by the Petitioners along with an Affidavit for change of Interpreter on behalf of the Petitioners.
Learned Senior Counsel Mr.K.K. Rai for the Petitioners submits that Mr.Jigmee Wangchuk Bhutia, the Interpreter earlier appointed is a Post Graduate Teacher, Enchey Government Senior Secondary School, Gangtok and is unable to continue as Interpreter owing to his professional and personal commitments. That, two names are being suggested to replace Mr. Jigmee Wangchuk Bhutia viz., Mr. Kelsang Sherpa and Mr. Karma Tashi Bhutia. That, although the petition does not reflect it but it is submitted today that Mr. Karma Tashi Bhutia, whose name is proposed as the alternative to Mr.Jigmee Wangchuk Bhutia, is a Post Graduate Teacher and therefore due to professional difficulties, may sometimes be unable to appear before the Learned Commissioner, hence, both Mr. Kelsang Sherpa and Mr. Karma Tashi Bhutia be appointed as Interpreters on behalf of the Petitioners, to avoid any delay in the examination of witnesses.
Learned Senior Counsel Mr. Anmole Prasad for Respondent No.3 submits that they have one Interpreter from their side hence in the fairness of things there ought to be only one Interpreter from the side of the Petitioners as well. Secondly, the petition does not reflect that both persons whose names are suggested, are to be appointed as Interpreters and, therefore, they ought to refrain from inserting a new prayer today. Learned Senior Counsel submits that appointment of Mr. Karma Tashi Bhutia as Interpreter, is acceptable to them.
The petition is not opposed to by Learned Additional Advocate General for Respondent No.1 and 2.
I have given due consideration to the submissions made before me today and accordingly order that Mr. Karma Tashi Bhutia, Post Graduate Teacher (Bhutia), Enchey Government Senior Secondary School, Gangtok, whose name is acceptable by Learned Senior Counsel for Respondent No.3, be appointed as Interpreter on behalf of the Petitioners to appear before the Learned Commissioner.
I.A. No.01 of 2021 stands disposed of.
