Bhaskar Raj Pradhan, J
There is a Caveat which has been filed by the respondent no.3. The Caveat has been filed through Mr. Rahul Rathi, learned counsel who is present in court today.
Mr. Thinlay Dorjee Bhutia, learned Government Advocate for respondent nos. 1, 2 and 4 to 6 appears on advance notice, accepts notice and waives formal notice thereof.
An affidavit of service has been filed by the petitioner dated 22.07.2023 in which it is stated that the respondent no.7 was served ‘Dasti’ but when they visited the residence of respondent no.3 for serving a copy he refused to receive the same and accordingly on 22.07.2023 posted a hard copy of the petition through registered post with acknowledgement due.
Mr. Rahul Rathi, learned counsel submits that he does not have a copy of the petition. The petitioner may serve a copy of the writ petition as well as the interim application along with all its annexures to Mr. Rahul Rathi, learned counsel during the course of the day.
