The instant writ petition is filed for quashing the F.I.R. being Lower Bazar P.S. Case No. 181 of 2024 registered under Sections 420, 467, 468, 471 and 120-B of the IPC pending in the Court of J.M. 1st Class, Ranchi
Informant of the case Kanta Tekriwal is the auction purchaser of land at village Dungra, Khunti and the petitioner is the recovery officer of Debt Recovery Tribunal, Ranchi. As per the case of the informant, after the auction purchase sale certificate was issued dated 18.05.2015 certifying the sale under the signature of K.B. Bhuina, the then Chief Manager-cum- Branch Head, (Authorised Officer), Indian Bank (Formerly Allahabad Bank), Harmu Road Branch, Harmu Road, Ranchi. Bank official however did not hand over the original documents despite the fact that Rs. 1,12,10,000/- had been deposited by her and only a sale certificate was issued.
It is alleged that after the auction sale, this property was mortgaged with Indian bank, the Bank authorities moved Debt Recovery Tribunal in which the same property was resold in the auction by the Debt Recovery Tribunal.
It is submitted by the learned counsel on behalf of the petitioner that matter has been amicably settled and for quashing of F.I.R. as a matter of fact three writ petitions were filed. The other three being W.P. (Cr.) No. 579 of 2024 W.P.(Cr.) No. 585 of 2024 and W.P.(Cr.) No. 589 of 2024 has been disposed of on the basis of a compromise entered between the respondent no. 2 (Kanta Tekriwal), and the FIR was quashed qua the other bank officials who had preferred the writ petitions.
In view of the undertaking given by the Bank to provide the possession as well as sale deed and title documents, the instant writ petition can be disposed of in the light of the compromise between the parties.
Learned counsel appearing on behalf of the respondent no. 2, Mr. Vipul Poddar submits that the title documents as well as possession of the auction property has already been received by respondent no. 2.
In this view of the matter, the writ petition is disposed of and the F.I.R. being Lower Bazar P.S. Case No. 181 of 2024, is quashed qua this petitioner.
Pending I.A., if any, stands disposed of.
