Judgment
The respondent no.1 IDBI Bank filed an O.A. bearing No. 183/2016 against the appellants and during the pendency of the said O.A. one M.A. bearing No. 94/2025 was filed by the respondent Bank for issuance of recovery certificate.
The DRT-II, Delhi vide order dated 10.12.2025 allowed the M.A. bearing No. 94/2025 and directions was issued to the registry for issuance of fresh recovery certificate in terms of the order dated 10.06.2026. The DRT-II, Delhi vide order dated 10.12.2025 also passed various other directions.
Appellant being aggrieved by the impugned order dated 10.12.2025 filed the present appeal.
Sh. Pawan Kumar Bansal, Advocate for the appellants stated that the subject matter of the present appeal as well as OA bearing No. 183/2016 has already been settled with the respondent bank. The respondent bank has already issued No Dues Certificate dated 05.05.2026.
The perusal of No Dues Certificate dated 05.05.2026 reflects that the loan account with the respondent bank has already been settled.
Sh. Pawan Kumar Bansal, Advocate for the appellant in view of issuance of No Dues Certificate dated 05.05.2026 seeks permission to withdraw the present appeal and further stated that the legal proceeding arising out of the recovery certificate are still pending before the Recovery Officer and are listed for 15.05.2026. He further stated that let the respondent be also directed to withdraw the proceeding pending before the Recovery Officer in pursuance of recovery certificate and scheduled for 15.05.2026.
Sh. Miling Garg, Advocate for the respondent bank stated that as the matter between the parties has already been settled as such the respondent does not have any objection if the present appeal is allowed to be dismissed as withdrawn and further proceeding arising out of recovery certificate and pending before the Recovery Officer and scheduled on 15.05.2026 shall be withdrawn accordingly.
In view of above submission, the present appeal is allowed to be dismissed as withdrawn.
