Judgment
The present petition has been filed under Section 482 Cr.P.C. to assail the order dated 4.1.2017 passed by the court of ACJM, Kaman, Bharatpur,
whereby Supurdgi of motorcycel bearing No. RJ05 SM 7347 was handed over to the respondent no.2.
It is admitted fact that the order passed by the ACJM, Kama, Bharatpur has been affirmed by the revisional court vide order dated 15.7.2017.
Investigating agency came to definite conclusion that the motorcycle in question on 11.1.2013 was purchased by the parents of respondent no.2 and at
the time of engagement on 13.1.2013, the same was handed over to the petitioner.
Two courts below having examined the evidence  gathered by the investigating agency came to conclusion that the sale consideration of the
motorcycle was paid by father of the respondent no.2. The present petition under Section 482 Cr.P.C. tantamount to second revision. Scope of
interference under Section 482 Cr.P.C. is very limited. Once two courts below have relied upon the evidence gathered by the investigating agency,
there is not ground for the third court to cause interference as no patent illegality or infirmity in the orders passed by the two courts below is
discernible.
Consequently, the present petition being devoid of merits, is dismissed.
